    Hey, all… any recommendations for a good traffic attorney that works in Monterey county? I got a BS speeding ticket from the CHP while traveling on their Hwy 1 Revenue Generation Zone, and while I could pay the fines and use traffic school to make it go away… I’d rather fight it.

    I have standard 60’s (black/yellow) plates; not sure what a “chp license plate” is?

    I call BS on this ticket because the officer passed my wife and I at a scenic pullout… we were just lounging there on folding chairs, enjoying the view and eating (I swear) donuts. We’d celebrated our anniversary down in SLO and were taking the scenic route back northward. We got back on the road minutes after the officer passed us, heading in the same direction. Maybe 15-20 minutes later I start getting Ka band, so I’m keeping the speed under 60. Still, we reel in the officer after a while; he pulls over, lets us pass, and then lights me up.

    He maintains that he measured me at 72 using rearward radar. I didn’t reach that speed, and feel he wrote the ticket based on the fact we finally caught up to him over a lengthy time period. Was our average speed greater than 55? Absolutely. But I dispute his “evidence”.

    I’ll follow up on this thread: the ticket was dismissed yesterday. I used Off The Record (thanks for the recommendation!), who put me in touch with Fight My Ticket to appear for me in Monterey county. Cost was $350. So even though traffic school was an option for this ticket, it absolutely made sense to contest it.

    Anyway, a good outcome. Excellent communication from Fight My Ticket: highly recommend!

    Always fight the ticket! When I was younger I was singled out for "speeding" on I-285 in Georgia. If you're not from there, the speed limit was 55 and absolutely NOBODY drove 55 or you would get rear ended. I was doing 72 which was the flow of traffic, but I had a shiny yellow sports car so the state patrol singled me out of the crowd. I didn't have money to get an attorney at the time so I plead NOLO and just paid the ticket thinking that would make it go away. BIG mistake. Insurance still found out about it and 22 over the limit triggered all kinds of extra "fees" on my insurance premium for years. I could have paid for an attorney many times over just from the insurance rate hikes.

    1. Fight first by requesting Trial by Declaration. Write or copy template explaining situation (I have templates or Google them). It cop doesn’t respond, you win.
    2. If cop responds, request Trial de Novo, court appearance. If cop doesn’t show up, you win.
    3. If cop shows up, request traffic school.

    You have 2 chances to win a ticket.
