To which, I stated that I agreed he didn't intentionally hit Ward, but the fact remains that the vehicle he was at the control of DID strike Ward and there is the possibility that this was a brush-back gone wrong. If a prosecutor and the grand jury both feel that way, there will be a negligent homicide criminal case arising out of this. However, I also see reasonable doubt. I, therefore, don't see a criminal conviction even if a case does proceed. Frankly, I think it would be a waste of resources to pursue. I continue to believe, however, there will either be, if there isn't already, a civil case (with a big settlement or an award reduced by the amount of Ward's culpability) or an even bigger settlement in order to avoid the civil case altogether. I agree. "The NY District Attorney will submit evidence against Tony Stewart to a grand jury." I would like to know what evidence the NY DA has fabricated in their small mind? I find it far fetched to think a Grand Jury will be able to find any 'intentional culpability' in this case, my opinion of course.
I agree with this. btw, my Penske friend called me last night and said..."well, I guess you were right...there may be more to this". look TS did not intend to kill anyone...period. that said his life will get more difficult before it gets better. I am still interested to see if there will be a ripple effect where the team and sponsors are concerned? this whole thing has the specific gavity...
The fact speaks for itself. There was a collision with TS' car and Ward's person and a corpse is the result. That's enough to seek an indictment. Maybe this is a bit of going through the motions on the part of the DA so as to be able to claim he/she fully-discharged their duty and didn't play any favorites. Perhaps there's so much heat on this, that it's much better to throw this over the fence to the Grand Jury and let them decide. And, it is really for the DA (who's apparently concluded there's enough to bring to the Grand Jury) and the Grand Jury (both of which may be privy to information we're not) to determine if the brush-back theory is enough to warrant an indictment for negligence on TS' part. However, unless there is evidence that we haven't yet heard about yet, I think the criminal prosecution ends pretty soon. I'd put a 70-80% likelihood on that, but there can almost never be absolute certainty. CW
