Schumacher & Taxi driver face punishment for speeding

    After several complaints about the fact that a WDC seems to be allowed to do whatever he wants on public roads, German police is now investigating if Schumacher is guilty of speeding. The Taxi driver might face a punishment for breach of the passenger transportation law. However, if Schumacher really drove 130 to 140 km/h (~85mph) on the speed limited road in question, his fine would be around 20€.

    Fine Michael Schumacher for speeding? What has this world come too, the man should be given an award for getting that thing to 85mph.

    So true... but it's somehow clear that after all the media attention, someone would jump up and scream hang him high...


    Well, if he really did 130 o 140km/h and got caught, I somehow doubt it would end up with 20€. Going 31-40km/h over the limit on country roads is 75€ and three points in the "central traffic register" (8 points there gives you a warning, 18 leads to deprivation of your driving license). 41-50 km/h over limit leads to 100€, three points and one month suspension of his driving license. Even with deduction of all tolerances, he'd end up at least with a point in the register... wheras I don't think he'd care too much about the money ;)

    Does germany have laws about "hearsay evidence"? It's not admissible in a US criminal court -- but in a german traffic court?

    No. Absolutely nothing will happen. But the police has to investigate after several people have complained.

    Just out to spend some tax dollars... Isn't mike a swiss citizen these days? I mean can the germans spell Diplomatic immunity? They have no witnesses, nor will they get some, they are on another government funded boondogle...

    Schumi needs to set a better example...

    I'm sure he could have gone faster if he wanted to. Maybe he toned it down for safety reasons. ;)

    Don't the German police have something better to do?

    Schumi can handle the fine. He may not be going to the German GP if they put out a warrant for his arrest though.

    If you read the article:
    There is a tolerance that has to be deducted for the speedometer not being calibrated. Once that is done there is maybe a true 10KM over and as such that is barely mentionable. On the Landstrasse I usually drive 140+ if it is nice and wide. 120-130 being average speed.
    Giving his capable hands I'd say he was merely "cruising" than driving fast.

    As for the Germans....man, I am so glad I left that ^%$#ing country.

    Before you write this bs - imagine what fine you got in the US! Also - I am pretty sure that Germany is one of the most "Island of Peace" on this globe. I

    If you are glad that you left the country - thats OK. But -please- don`t offend those who love to be here because there are many, many reason to stay!

    I happen to drive on those roads, too, thus I happen to know first hand that the tolerance is 3-5% .... 30 or 40km/h is a bit more than that.

    12 points here your next case and there thinking of lowering it, and just recently a police chief who has been on TV banging on about speeding just got caught well over the limit, talk about do I say not as I do pisses me off.

    Don't no how this thread got to be about slagging Germans off though :confused:

    I have never been so I could,nt comment but I do go Austria a lot and I love the people, there again I love skiing and there brilllant at that...:)

    Except that the driver isn't required to give testimony that would incriminate himself (under the US Fifth Amendment -- germany may differ).

    The papers reporting "what the driver said" would be "hearsay".

    I didn't hear anything to suggest that the taxi driver would be charged. If he simply appears as a witness to confirm MS was speeding self incrimination is not an issue.

    Yes, that's true, but the newspaper articles are not going to be produced as evidence in court.
