Question...can you use a car (Ferrari) picture on your shirts and sell it?

    This is just my take on it from my experiences as an artist making club and Fchat clothing, don't take it as legal advice:

    You cannot use the FERRARI name logo, the horse/"Cavallino", the shield or the vertical badge. Those are all trademarks. I haven't seen any problems with using images or artwork of the cars themselves if they do not have those trademarks. For example, the Monterey embroidered shirt had a Ferrari on it without recognizeable badging.

    They don't want anything that looks like it is official Ferrari gear, by resemblance or using their trademarks. You could have a drawing or photo of the car without those though.

    Jack - you could use a picture of your own car, but you couldn't sell shirts of it with the logos distinguishable.

    Ferrari has IP watchdog agencies that monitor the internet and stores for counterfeit or infringing goods. Ferrari people also look around here too. Some guys from Puma are also users here, and Puma pays tens of millions to use the Ferrari name and TM's, so I could see them getting involved in stopping infringement too.

    So what's the deal with all the counterfeits? I know it takes time to chase down these people, but there's a lot of fakes out there, and they seem to consistently come from the same places. Are they powerless against these Asian producers of the knockoffs we see all over ebay?

    I don't think they're powerless, but there are difficulties in getting Asian authorities to raid these types of operations. I would think they would probably invest more time into such cases of mass counterfeiters. There are private companies (including at least one hired by Ferrari that I know of personally) that spend their time hunting for merchandise and IP infringements for their clients, constantly surfing the web, shopping and otherwise tracking it down.

    With a situation with an America-based operation like bmwm3 mentions, he would be very easy to find and would get a cease-and-desist letter from F SpA's IP lawyers in the USA, www.cll.com .

    manuals and parts books on ebay...no way these "publishers" have the Ferrari copyright to produce and sell those xerox and cd copies of those manuals.
