Please advise !!! Title problem...

    I purchased a 512 from a used car dealer from Southern California who specializes in selling used F cars. The car was just delivered to me this evening where I live in Westchester NY, almost 2 months after signing the original agreement. THe car was being belt serviced and then shipped to NY - both of which took much longer than originally anticipated.

    The problem I am having is that the title this dealer sent me has a mistake on it. In that, the original owner when signing off the car on the title to the dealer signed it in the wrong space.

    NY DMV does not accept the error on the title even with a notarized affidavit of correction sent by the dealer. I went to 2 DMVs in the local county over 3 days and they both refused to give me new plates stating that I need a new title.

    Now this dealer (the owner) is refusing to answer my mails or calls in to his office. He referred me to a DMV title service company in Brooklyn. And after consulting with two such local services I was told that I would need a new title.

    What recourse to I have outside of going legal for which I have the resources, the will and the time to do so....just to prove the point. But it does not help me drive the car in the meantime. Its been a very frustrating experience with this dealer.

    Write or call the original owner that is on the title and see if you can get him to resign it for you.

    How about saying you lost the title and do an application for reassignment of lost title?

    I would work the NY DMV end of the process rather than hassle with a dealer 3,000 miles away. At the DMV, don't waste time with clerks. Politely work your way up the management chain if you are not getting satisfaction for what seems to be a simple error that should be overlooked. Another tack is to get in touch with your local NY State (not U.S.) legislators and explain the situation. They usually are eager to curry favor with potential voters by helping with bureaucratic snafus like this one.

    Thank you all for your inputs.

    I got an email from the dealer this afternoon stating send the Title back and they will get me a new one ASAP. Not sure what ASAP means to them but I sure would not want to wait another month or so for the new title.

    Also not sure if giving back the title to him is a good idea.

    Will keep you posted on how it goes or ends up.

    By law the dealer has to give you a proper title reassigned correctly, glad to hear they came to their senses, it would be expensive for them not to if you took legal action against them, you can also contact the state the dealer is in and they more than likely would revoke his bond that is needed for his dealers license.

    I'm not sure what state he is in but I have had to wait 30 days before on new titles I needed. Some can get them in is little as the same day if the dealer walks it in.

    Thanks Chip.

    He now says atleast 2 weeks for a new title. And knowing how he works this could turn into another 2 month saga. Which is what i want to avoid. It sucks having a 'new' car in the garage and not being able to drive it :(

    He does not seem to have any motivation to help since the money is in the bank and I am thinking that the only reason he is now obliging is because one of his sales person is a member of Fchat and may have seen this post.

    Does any one know how long a new title can be obtained in Southern California?

    See if the dealer will give you 60 day temporary plates in the meantime while working on the new title , i had the same problem with my GT4 , i had the notarized form that stated the title was filed out in error , in the wrong spot , i got the supervisor , + i mentioned i called Albany DMV , Albany stated they should accept the affidavid, + let me register it, not only that , but the title only had the 8 digit or so Dino # on there , it still got registered with the small digit # . Good Luck

    Good call.
    Contacting the DMV of origination (California) should help if nothing else will.

    All cars before 1981 had less than 17 digit VIN's, including my 78 308, it only had 5 digits.
    My '79, BMW 635 has a 7 digit VIN. No problems with either.
    The short VIN should be a non-issue in all 50 states.

    Eric this exactly the same problem i am having and even with a notarized affidavit of correction the DMV does not want to accept title. Had the local DMV supervisor fax the title to Albany and apparently it got rejected from there.
    The dealer states that CA does give out temp registration for out of state sales !?!

    I have documented all my communications and will be calling the FLA DMV where the original owners title is from.

    Gentlemen,

    I finally was able to register my car and get plates for my 512M. It took 4 trips to 3 differrent DMVs over a week plus help from an attorney friend to sort things out.

    Its funny how selective and arbritary the DMV seems at times.

    Anyways thank you all for your inputs and support. Will get a pic or two online shortly.

    Your dealer is obligated to refund your money until he makes your title good.

    If not you need to take legal action right away.

    Selling you a car with out a good title is stealing and illegal ,your car is worth nothing with out it.

    Be aware ,any and the seemingly not important title issue can and is usually is serious trouble, usually hiding illegal actions in transfer of ownership and that is why DMVs around the country are so strict and they should stay that way.
    All dealers know title work and they are policed by their DMV to do so properly.

    Refunding your money is the LEAST they should do until title is good.

    If they do not take care of this like is the end of the world for them they need some spanking and you should do so right away.
    When a dealer buys a car from another dealer or auction they do not pay even if they take possession of the car until a good title is available.

    In Illinois and in most states dealers have what's called an inter-state drive away sticker. This allows an out of state purchaser to get 7-10 days of driving on a temp sticker in order to drive the car to their neck of the woods and than register it. Ask them for a few with back to back dates that total a few weeks. You will be able to at least drive the car. Post some pics please.

    Did you buy the red one under 100K? If so, I had my friend call on it, and he told my friend that the car was sold but the new buyer may consider selling it. Hope this is not the same guy we are talking about. Now you can come and join us TR owners... www.prancingthunder.com

    Mario and Geno, thanks for your inputs. I got the title sorted out and regstered the car. The dealer was not of much help and said that CA does not give out temp registeration.

    After searching FChat for this dealer he seems to have had a title problem with another buyer along with some other issues.

    This was an emotional buy. After looking at three 512TRs for a year where things did'nt work out for various reasons I was tired and just wanted to buy one and enjoy it over the summer.

    btw Al (TestarossaLover) Yes this is the same car from that dealer. But no, after all this saga I dont have any intentions of selling...just yet. Will defintely join your group.

    I'm glad you got the title sorted out. A big FREEZE...MIAMI VICE ! out to you.

    You should really post the dealer as he was NO help in the matter and we all need to be warned.

    This lack of customer service should not happen from any dealer....especially those dealing in exotic cars! It's unacceptable...
