MA traffic violations / what info do the authorities have?

    this is OT but regional, so i'm posting it here.

    my last three traffic stops were:
    * failure to yield
    * no inspection sticker
    * doing 46 in a 30 zone

    i was able to successfully fight all three, and win.

    what i'm curious to know is, what information gets put on my permanent record that the police officers and court officers can see?

    do they see those violations or are they wiped from the record since i was found "not responsible" in each case?

    and what about warnings (got one a couple years ago)? are those on the computer system?

    any info appreciated.

    Unfortunately, I have had significant experience in this area. While I can not speak for Massachussetts, the State of Connecticut could not see any of the violations that I had fought and prevailed in when I had a significant run in with the law. In the end, fighting the previous violations saved my butt. If they were available for the prosecution to see, I might not be typing this from home.

    I don.t know if it is the same but years ago when I was a bit more conected to this stuff in ma. this is how it worked .lets say hypothedicaly you could fix a ticket (we all know that that is not possible) you would ask for a hearing and your connection would get to the clerk majistrate and you would be verr nice in fromt of him and he would let you off(just don't admit to guilt of offence) well that is great untill you go ip before the court for about the 6 or 7 th time your records are in front of the CM from all the outher times that you have got a ticket and it is geting harder to get the tickets fixed because the CM is now geting his hands tied how many times does he want to let you go . I was asked to NOT ask to help this one friend again because it was an the CM felt thst his driving record was getting way way out of line.On the warning it used to be (and i think it is still the same) that in ma a writen warning is a moving moving violation and it count's just like a ticket (3 of them and yuo can lose your licence),as a matter of a fact some cop's will give a you warning over a ticket because they can not be fixed (no chance to go to court and see your friend the cm).I just got a written warning for going 36 in a 30 what a prick you know that EVAN withOUT a CM IN your pocket that that ticket would be easy to get off on,but if things are still the same I am now stuck with 1 strike and 2 to go for the next year .

    dave - so you're saying that even though the CM finds you "not responsible" and you're off the hook, the record of the violation and the record of the CM finding you "not responsible" remains on the books?

    can the police officers see this info when they pull you over?

    or does only the CM have access at the hearing? at my recent hearing (which i won on the merits - i have no CM in my pocket, sad to say!) the CM spent a ton of time looking at his computer. maybe he was just surfing the net for porn, but he mostly stared at the computer during hte exercise tap tapping away and reading.

    the only GOOD thing about warnings is that they don't show as points on your insurance. at the end of the day, that's what hurts. i'd be happy to pay the fines, but the insurance increases are wholly unreasonable. i'm not against penalties in general, but the system is effectively a progressive tax.

    ps: and does the three-strikes rule run calendar years or trailing twelve months?

    i THINK THAT IN THE OLD DAYS THAT ONLY THE cm HAD THE ABILITY TO SEE YOUR OLD FINDINGS ,KNOW I DON'T KNOW WHAT INFO THE COPS HAVE IN THERE LITTLE LAP TOP IN THERE CARS sorry for the capt. letters ,dont have time to re type ,rember i type like a 2 year old ,and on the 3 strike thing I have never been able to find out for sure but I think it is calender.but not sure ,and I know people that have 4 tickets and nothing happened ,sliped throught the cracks????

    When an officer pulls you up on their laptop, they can run a report and see your entire history. On top of that every time your plate is run (regardless of what it was for) the hit is recorded and they can even go as far as to add notes (subject was verbally abusive etc.)

    I remember chirping the tires in my 442 4sp (very easy with 14 inch tires, 3.90 gears, 500ft lbs of torque and a standard), getting pulled over, getting hassled, having the cop have me wait (while he pulled up my records) and then repeat to me evey traffic offense I've had since I started driving.

    Thats ridiculous, some jerk-cop gives you a hard time and now all the others see it? my god...

    was pulled over for an inspection sticker the other day, cop seemed nice enough, so I asked him. If they dont run a check (they dont always) then they dont get any significant info, if they look you up, they can find every little thing "ever on your driving record"...dont know if EVERYTHING, but I'd be nice so they dont see any past problems;) God, I hate them.
