How did Andy Warhol get away with using stock photos without permission?

    Some of the most famous Andy Warhol prints use PR photos like Marilyn Monroe or Elvis Presley (in cowboy garb with drawn pistol). I have never heard of the photo rights holders protesting for violation of copyright yet when that former street artist used Obama's picture (from Associated Press) in an solarized style artwork he was sued. So what's the rule? Personally I think any photo released as a PR photo is "fair game" though I notice the car auction companies say their pictures can only be used if you mention their auction.
