    This is the same story with every iconic design. Carroll Shelby complained endlessly about Cobra knock-offs (Factory 5) that weren't paying "royalties" for "his" design. The problem has been with any Patent or Trademark.......it is use or lose.

    The challenge is you basically have to keep producing the shape to keep the rights. Recent interpretations including this one separate toy cars from making the automobile.

    What about Bizzarini and Scaglietti, who actually styled the car? Why were they not included in the suit?

    The Trademark in question can only belong to one company. It was filed in 2007 by Ferrari and allegedly.....Ferrari failed to meet the use test for enforcing it. The EU makes up its own rules when it comes to Patents, Trademarks and Copyrights.
