    Can someone tell me what to do. I bought a 400i Straman on Ebay. Paid in full within a week like always. When time came to load the car the starter failed. Seller ordered a new starter and installed it. Second attempt to load and the starter failed again. I offered to buy the car as is with a price reduction but he sid he would refund my purchase in FULL including my loss with dollar exchange. Took a while and got $34500 back. I'm still missing $6200 to be fully refunded. I've been trying to email him many times but he never respond.

    Can a lawyer tell me what to do? Anyone here can help?

    Just to let you know I have had bad experience with this seller on Ebay. Never got the car and refund me only part of my payment. Still missing $6200 cdn. My purchase was on Feb 25 2016.

    Call them. Emails are easy to ignore.

    Call Ebay, explain the problem. Don't expect much help, but worth a shot.

    I have no clue about international law as it pertains to this issue, you're gonna need someone who does, who practices in PA, preferably in the Allentown area.

    Good luck with these guys, hope you recover your lost funds.

    What did you pay for the car? Not understanding the promise to do a refund "including what I lost with the dollar exchange." Are you saying the dollar:CDN dollar exchange rate changed and the seller offered to pay the difference? If thats so, then wouldnt the seller be taking a large financial loss to take the car back (why would they offer that)?

    I would suspect most sellers, if they offered you money back, wouldn't cover shipping/exchange rates/etc....

    Am I misundertsnading?

    How was the $34,500 refund arrived at? Whats the $6000cdn (4000 US?) for?

    Assuming you had a PPI that verified the car was in working order, I would have accepted the car with the starter issue....especially buying out of country.

    I offered him to buy the car as is with a price reduction which he refused. The refund was sent from two different sources he told me. One from his bank where I first sent the payment and the other from another source. The one from the bank came to me to the amount of $34500cdn. That's all I ever received which is $6200 less than what it costed me to pay him. He didn't even refund the full US amount I paid for the car.

    He told me he was going to refund me ALL I had spent to send him the money. I'm a man of his words and I expect people to do the same. He SAID he would and for this reason he SHOULD.

    An agreement is an agreement and should be respected.

Pretty sure if you've been waiting two Months for a refund you have gotten bent.:( Had a similar situation happened a few years ago where I sent this individual in Florida a $15,000 deposit on a ferrari, he in turn sold it to another for a higher agreed-upon price then was not returning my deposit. Finally told him that he had 10 days for the total amount of funds to be redeposited into my glacier Bank account or I, with the help of glacier Bank was going to have him charged with intra-state theft of funds. It worked! The last day the funds hit my account. I have no sympathy or patience for a thief. Best of luck.

    Ditto... Most expensive purchase on eBay has been $600. And I was nervous. All went well...

    Sending a stranger $40,000..., waaaaayyyyy above my comfort level...

    To the op, time for either a layer to write a letter, or caulk it up as an expensive lesson...

    You could file in small claims court, but travel costs would offset any proceeds...

    first, what do you currently have as information, name, address, telephone?

    I assume the car is already sold to another (higher paying) party, so no going back to accepting it as is?

    If telephone, that could be a good start to calmly explore where he thinks he stands.

    If I was in your shoes, I would write down for myself what the USD amount was you sent (as the auction was in USD and my belief is that it should not be on the seller's side to worry or incorporate for possible exchange rate conversions or associated fees) and what a reasonable conversion into CAD funds should have amounted to. Historical FMV rates for the day the funds were re-transferred can be found here, 10-Year Currency Converter - Bank of Canada, and realistically the actual rate will differ plus there are additional transaction fees. The part where he offers to make up for all possible extra costs is somewhat hard for me to understand and although in theory generous makes me doubting the seriousness (either no experience or had no intention from the get-go).

    Assess what you think he is up to. The direction with small claims court is very good, you now have the choice of announcing your intention via email or have it delivered by mail.

    Last, not least, assume that he is following this board, so prepare at some point to switch to personal messages,

    And then you should have taken the car as-is per the agreed price. 30-something year old $40k cars will always have minor issues.

    Actually, he could have loaded it up with the bad starter and just not told you.

    I bought MANY expensive items from ebay over the years, Motorhomes, cars and more with never any serious problems. This is the first time it happen to me.

    The timing was bad because I was just out of a serious surgery and been in hospital for 12 days. I was not in a health position to jump in the car and go there to fix the problem.

    I really don't like when people don't respect their promesses in business. It sucks

    He never negotiated for the starter, he just said he would not sell the car not running. I would probably have agreed to buy it as is for the same price. But he didn't want.

    When I told him I would buy the car as is because I'm a mechanic and the starter is no big deal for me and that I was loosing money in the dollar exchange he said he'd talk with his partner and be back to me. His answer was we will refund you in total including your lost in the banking for the exchange.

    Well, I agreed with deception but what could I do????
