VCAT, make the wrong decision day in day out ,regarding certain platforms they adjudicate at the expense so often of the plaintiff even though the order has been made in favour of the plaintiff . The system is flawed in so many areas , be it enforcement of a Vcat order or an appeal , its just that most whom go to Vcat are unaware of this .
But what's the alternative ? In the ACT we "ACAT", will hear claims up to 20K, I've used it a couple of times and been happy with the outcome.

The problem of course is cost of going to another court .Which is the Magistrates court (amounts up to 100K? Example , consumer can go to VCAT re a claim against a trade person for a small application fee, but a tradesman who has been stiffed by a lowlife who refuses to pay , its the Magistrates court and significant costs often vs the bill! Plenty of lowlife know this and play the game of duding . An order is made in VCAT in favour of the plaintiff, the defendant refuses to pay ? Then what more expense to the plaintiff and getting the order enforced by another court , VCAT wash their hands once the order has been made. And don't get me started on .valuations and planning, freedom of information, tenants/landlords, guardianship or equal opportunity . Courts as we all know where they can favour the little guy............VCAT ALL the time be it correct or not!
That's what I was getting at Why can't the tradesman use VCAT ? But VCAT can't hear those sort of matters.

Well that's not fair, as you say, magistrate court is $$$, so not worth pursuing a "dudder" Interesting.
Well the dudders know how to work the system . Most tradies just move on , not all. My advice to anyone who gets duded on payment by a consumer . Engage a debt collector , bad mouth the consumer to all and stalk 'em into a toilet cube
The only thing I agree with there is that you're right about what needs to be done if an order is against someone and they don't pay. However, it costs about $50 or something minor to get it ratified (not the right word) by the magistrates Court, then the sheriff and police will act to enforce. It's not that hard. I've never heard of anyone not paying up anyway, except in one case where they simply didn't have the funds. Sounds to me like you feel you've been wronged a few times in court. That's probably because of your narcissism. I'm yet to see them get one wrong from the inside knowledge I have at the time of the hearing. I like to watch! However, they probably do get it wrong sometimes.... Just like judges. They're human! But overall, they're pretty good.
The police don't act in these type issues at all, the Sherriff's office yes . Be interested to know your thoughts on people who set up traddies for a job, knowing fully from the start , they would never pay for the completed job?
I've seen the damage they have done to others ,there hatred of lenders that's 1st hand . The initial idea was smart , cheap and fair way for a consumer to win , they just have gone to far towards the consumer in the decision making .
I've seen applications against businesses and I've seen applications by businesses. I've seen people and businesses both self represented and represented. I've never seen anyone treated any differently to anyone else. I'd say most likely you just have really shifty friends who lose at VCAT and convince you they were in the right.
