I agree on all points! After the accident, Ferrari Maserati of Vancouver (FMOV) took my Ferrari (without my knowledge or permission) to what they later called their "go to" auto body shop. However, they took it to at least one other auto body shop for an estimate to repair the damage (again without my knowledge or permission). I suspect that what they later called their "go to" auto body shop was simply the one which gave them the lowest estimate to repair the damage - specifically $26,755! Of course, I eventually (in May 2014) had my Ferrari repaired by Korva World Class Collision at a cost of $35,644. I trusted Boris Korva to do the work, and he was very professional. He is a man of integrity. In contrast, not only did FMOV fail to loan me a Ferrari free of charge, but they also refused to release my Ferrari unless I paid the invoice for the very tune up which resulted in the more than $36,000 damage! FMOV could take a lesson from Boris regarding providing good customer service!

I agree regarding minimum! As mind boggling as it is, the story is entirely accurate. The only thing that came close to matching my shock when I saw my damaged Ferrari was the highly unprofessional way in which it was handled by FMOV. I learned from my experience that they do not represent the great Ferrari name - they represent themselves and their own financial self-interest. By they, I mean Brian Ross, owner, Mark Edmonds, manager, and Ash Mohsen, employee.

Thank you for your support! Yes, I recently apprised FNA of my experience with FMOV, and they are reviewing the case. The malicious and mean-spirited way in which FMOV treated me (even after damaging my Ferrari) is simply too egregious to give them a free pass. Hopefully, karma will restore balance. Thank you again!

I appreciate and share your sentiments! Personally, I don't know how Brain Ross, Mark Edmonds, and Ash Mohsen can sleep at night, or even look their customers in the eyes. In my view, their arrogance and greed will eventually be their downfall. It is worth repeating that acting with integrity may not make a person rich, but it leads to a richness in character that money can never buy.

It is the support from people like yourself and others in the Ferrari community that give me the motivation and energy to keep up the good fight - for all of us. Thank you!

I cant say how I would have reacted in your specific situation but I would have made their lives hell in as many lawful way as possible.

The wife and I just came out on the good side of a lawsuit. Its hell and I dont recommend it lightly. You tread in a system 'for the common man' but completely un navigable by a layman. Its a numbers game filled with posturing and bluffs by both sides. Its not what just, its what can be proved or what will be allowed in court. Witness lie to protect themselves, attorneys tear down you psyche and make you second guess yourself.

You make an excellent point about being treated decently from the beginning. In particular, if Ash Mohsen had been honest from the beginning about the extent of damage to my Ferrari (instead of saying it was "just a scratch"), I would have been better prepared psychologically when I saw the far more extensive damage to my Ferrari. My thinking at the time was, "Why did he lie?" He must have known I would see the actual damage upon my return to Vancouver from a business trip in Ottawa. This, combined with the fact that FMOV initially took my damaged Ferrari to different auto body shops before they even told me about the damage, leaves me to wonder whether they were secretly trying to have the damage repaired before I returned to Vancouver, and the only reason they did not do this is because the damage was too great (and likely required parts to be ordered). This was the nature of my thought processes, but only they know for sure what their intentions were when they initially took my damaged Ferrari to different auto body shops before they even told me about the damage. It should be noted that FMOV did not contact me about the damage - I was the one who called Ash Mohsen while I was on the way to the Ottawa airport (to return to Vancouver) to see if the scheduled tune-up was done because I was planning to pick the Ferrari up the next day in Vancouver.

Do you know whether this incident ever came to the attention of Ferrari SpA? The correct result in my view would have been for Ferrari to launch an investigation, fine the dealer, and bend over backwards to make things right with the customer - up to and including shipping the car back to the factory for proper repair. This is what one should be entitled to. It's disappointing that this didn't happen.

I'm sorry you had to go through all that, but congratulations on winning your case! Your comments bring to mind the fact that Mark Edmonds maintained in front of a Supreme Court Judge (as noted in the Judge's decision) that the employee who issued the invoice [emailed to me on July 23, 2013 for the late May 2013 tune-up] did so without his knowledge. What was not noted in the Judge's decision was the employee who emailed me the invoice was none other than Ash Mohsen! Mark Edmonds and Ash Mohsen were the two people who were most involved from the beginning when I returned to Vancouver to see the damage to my Ferrari in late May 2013. On July 22, 2013, they received notice of my lawsuit against FMOV, and on the next day Ash Mohsen emailed me the invoice for the tune-up. With the highly sensitive situation regarding my damaged Ferrari unresolved and a lawsuit underway, what is the likelihood that Ash Mohsen would not have consulted with Mark Edmonds (manager) before emailing me an invoice for the very tune-up which resulted in the more than $36,000 damage to my Ferrari? And why was the invoice sent more then 7 weeks after the tune-up? Things that make you go hmmm.

I very recently called the Ferrari SpA in Italy, but the person I spoke with did not know where to transfer my call to make a complaint. I will ask the FNA representative for more specific contact information for SpA. Thank you for your support!

Only places to get worse results than dealer would be the factory or north America HQ. Puhleez!

    Dr. M,

You may want to consider a letter to one of the senior SpA execs (Piero Ferrari or Sergio Marchionne) - describing your experience very briefly, a paragraph or two, not demanding or asking for anything. Tell them you were surprised that you had to take legal action against a dealer to remedy damage to your car caused by the dealer during a routine service and you thought they might share your astonishment. Will be interesting to see if they step up - they just might.

Just my unsolicited advice, needless to say.

Let us know how it goes.
My guess is something like this-
"Sorry for your difficulty. Fov is an independent entity that we cannot control...."

I would send the letters overnight Fedex and request adult signature NOT with the regular mail . I needed some Fedex receipts for a sales tax audit and got nowhere with my rep for weeks , so I called the CEO Fred Smith and didn't get a hold of him but I did get his secretary who was very sympathetic and had my receipts to me in 2 days thus saving me a small fortune. Try to get Sergio's secretary's name and send it overnight to her. Good luck bro.

Wow just read this thread, disgusting attitude of the dealership. Sounds like a shady used car dealership with the name of " All Night Car Sales" get them while they are still hot.
Do keep us informed as to what anyone higher up has to say.

I am also. This thread has had close to 20,000 views. I don't know if Ferrari SpA knows of it's existence or that you will no doubt be publishing the response you get back. I just hope they take your grievance with FMoV seriously and not just brush you off. It won't make them very popular with their North American customers, existing or future, if they don't respond in a meaningful way. IMO, a poor response will just solidify the image of the Vancouver dealer with that of the whole organization. I really hope that Ferrari SpA reprimands the FMoV dealer severely for their obvious lack of business ethics. I'd hate to see a company like Ferrari SpA adopting a motto of "there's one born every minute".

I could not have said it any better myself! In the letters I sent to the Chairman and Vice-Chairman of Ferrari S.p.A in Italy, I provided a brief overview of my experience with FMoV, and referenced this thread for the details of the court case and Ferrari enthusiasts' responses. I completely agree with you that Ferrari S.p.A's actions (or lack thereof) will speak louder than their words to the Ferrari community.
