    It still looks like there will be plenty of noise. Their rights end where mine begin and they are infringing on something thats been around probably longer than they've been alive. They are lucky I don't live there or I'd buy some rice just to piss everyone else off from 200ft away rather than 2 miles away.

    blithering idiots... i say infineon counter-sues the lillys separately and jointly (with the others who signed on) for infringement of rights to do business that has been prior existing and providing great economic support and development for the area, etc. + on historic reasons. the track was there long before the lillys...

    what next? it's raining a lot here. im gonna sue the state, all the other states, the fed gov't and the local weatherman...

    Ocean City, NJ: Developers poured dirt into the bay and built a golf course. Entrepeneurs poured more dirt and concrete further into the bay, and built an airport (private planes).

    20 years later, after casino gaming passed in AC, cash and dash developers poured tons of dirt into the bay and built condos on either end of the runway.

    Next thing you know, you get "noise abatement procedures". You didn't look out of the windows before you bought the condo?

    I still remember what one instructor told me about noise abatement: "**** it: they'd rather hear you fly over than have you crash into their living room."

    A lot of these clowns think that they can get the track shut down by being a pain for a few months and 'BINGO' their property values will instantly go up.

    What rubs everyone the wrong way is that someone moves onto a piece of real property where there is a pre-existing neighbor/condition/use at a neighboring property that they don't like and then complains about the neighbor/condition/use. However, under the well-established legal doctrine of "coming to the nuisance", such a neighbor/condition/use is protected.

    So, the real question is who was there first. If the race circuit pre-exists, someone who moves in after the fact (when they knew, or should have known, about the neighbor/condition/use) cannot then civilly sue and win. That said, I cannot understand why the law is pandering so much to people who moved nearby and then complain. Maybe it's politics. Maybe it's the fact that Infineon was "expanding" and therefore had to get approval from a "political" body (although if the track exists, expanding it shouldn't affect the noise level much). Maybe the plaintiff argued that there would be an increase in traffic, an adverse affect on the environment, or some other novel argument. However, this legal doctrine should govern, and I'm unsure of why it isn't being argued vehemently by the circuit owner(s).

    Unfortunately, this is such a common story, especially here on the East Coast. I've raced at Lime Rock, Summit Point, and Roebling Road (among others) that have rigid decibel limits and some very strange hours of operation. (I've heard that the local police are called frequently to Roebling Road when cars exceeding the limit have been on the track. The officers will actually deduce which group of cars was on the track at the time of the complaint, walk the paddock, and fine the owner if they can identify them with reasonable certainty. They'll also prevent the car from running any longer unless "modificiations" are made. We've installed baffles that re-direct the sound away from the decibel meters, for instance). Unfortunately, as an ever-encroaching population gets nearer and nearer to race circuits, it's only going to get worse.

    And, unfortunately, the suggestion that a hog farm might replace an airport wouldn't work either. I suspect your comment was in jest, but smell is treated like noise and would interfere with an adjacent (or other downwind) property Owner's right of "quiet enjoyment." Light (as in floodlights at night), is also viewed as a condition that can affect an adjacent owner's property rights.

    Frustrating, I know. I'm getting so tired of decisions made out of expediency and "political correctness".

    I can't wait until MotoGP comes to Laguna. The Ducati is 130dB in and of itself. Add to that the uncorked RC211Vs, the Yamaha M1 et al. and it's goingto be one VERY loud weekend. I hope all those golf club whinners get earbleeds.

    I hate this new fad of if you don't like someone, they're suddenly gay. There's nothing wrong with gay people. One of my friends told me he was gay, and I don't think of him differently now, that would be stupid. He was a good friend before, why can't he be after.

    Sadly the same happened in my neck of the woods. Dragstrip that had existed for 55 years! And A great racing circuit that was one of the best and equally around for similiar years. Both were beaten to death these past 2 years and now no longer exist. Horrible! and not fair for auto enthusiasts.

    This is how The Bridge in Bridgehampton ceased to be. The home owners pushed the track, a piece of history mind you, out of existance. It was motivated by noise concerns but I believe they used the enviormental card to get the job done.

    What happened next? The land gets bought and turned into a golf course which ironically poses a far greater threat to the fragile enviornment than the racetrack. What a bunch of tools.

    Does anyone remember the DC grand prix of a few years ago? Different situation from the first post, of course, because the track was a temporary circuit. From what I saw, a good time was had by families on three warm days, lots of good racing, not a bad track considering - but our local newsrag portrayed the event as an insult, even a danger, to those who lived nearby. A photo accompanying one article showed an elderly woman, hands over her ears, a look of horrow on her face. Oh, no, THREE DAYS of noise! No more DC grand prix.

    Idiots.

    I hope Laguna Seca survives its neighbors.

    IIRC, there was also a dispute between the promoter and the District about not enough money changing hands. While a few vocal minorities certainly made a lot of noise about the noise, I was under the impression that the death knell was the failure of the promoter to pay the District what the District felt it was owed. I've never seen the contract, but the answer lies within!
