Houston McLaren Driver Followed, Shot and Robbed

Oof. That really sucks. On a hill country drive it's easy to tell if somebody is following you but in the city with alot of traffic you pretty much have to drive a few streets out of your way to spot a tail.

 

I always check traffic patterns on the way home.....as a few years ago a guy followed me home, turns out he just wanted to talk about my Diablo Roadster but it was a wake up call to pay more attention.

Plus I don’t take exotics out at night.....

 

Always check your rear view mirror when you are close to your home. Years ago I was followed on a motorcycle late at night the last two-three miles from my home. I stopped close to my home, at a four way stop sign and waited. I was not the only person at the four way stop sign who was waiting early in the morning. There could have been up to four people inside the car just waiting for me to pull up in my driveway and drop the kickstand.

 

Ideally one has a gated car park if in the city.

We have lost 12 SETS of wheels and tires, from our "Gated Car Park".....I think it's Uber eats and delivery drivers, it seems the whole world can drive right thru my gate....

Houston police are on it...... problem is that description matches a few million suspects.

 

Too bad it wasn't 2 men in hoodies with 40 caliber holes in their chests.

It seems that area of Houston around the galleria has gone downhill ... lots of random foot-traffic Of dudes w backpacks.

not much innocent hiking to do around that part of town... and they don’t have tourist-Fanny-packs and street maps for site seeing.

 

I am a CHL holder and carry pretty much all the time. The concern is going to dinner in the Huracan, having a glass of wine with dinner and getting pulled over with a weapon in the car. Ethical dilemma.
If I remember correctly, carrying a firearm in a car after any consumption of measurable alcohol is a felony.

 

I agree with the part of the dilemma but you need to reread the law.

Carrying and drinking is not illegal. Carrying while intoxicated is. In the case of firearms, intoxicated is an officers discretion. And it is a misdemeanor. If its legal to drive it is legal to carry.

My other half has a license too. If I get a little carried away she gets the keys and the gun.

 

Thanks Brian, that helps. The key is discretion of the officer. My concern is the majority of officers in the DFW area would love to pull over a doctor in a Lamborghini or Ferrari with a pistol in the car and "intoxicated" in their opinion, even if the driver had only had a glass of wine or two. If the DWI charge fails, then unlawful carrying charge goes away also. If the DWI charge sticks, then the unlawful carry charge will also.

04/05 I was at a local FCA Christmas event and had too many drinks of red wine. I drove the car straight as an arrow. My wife was with me in the car and screamed when I did not even notice the light was red. Thanks Hun. The hair on the back of my neck stood up. Also missed the Beltway 8 exit. That is the last time I drove with too much wine.

Too much booze and a sport bike is an interesting and different experience .

 

I connected w biological father late in life .. he’s retired state trooper. I owe it to him to never drink and drive. Corny but it’s how I roll.

 

The Galleria area has been targeted by rip offs for decades.

My wife's father lives North of the Galleria area, a neighbor was followed home, robbed, and shot in the head. Luckily he will survive. Y'all be careful out there.

 

Criminal defense lawyer here with a lot of experience doing search and seizure work. The answer to your question is somewhat subjective - assuming a cop has probable cause to make a traffic stop (and a minor traffic violation is all it takes) the general rule is that the level of intrusion is cast in the light of reasonableness. A stop for an expired tag should not invite a dialogue about whether you have anything of interest in the car but it occasionally does if the cop is feeling his oats. The black letter of the law says that the path of the investigation should serve the interests of the stop ...where it gets tricky is when other factors start to supplement the investigation, e.g. an odor of alcohol or weed or red eyes ...now the stop becomes more intrusive because those additional factors are bootstrapped and the scope of the investigation broadens. If your car is getting towed (grossly excessive speed, expired tag or insurance ...whatever) it's going to get searched - it's what we call an "inventory search" and it's premised upon the notion that the police department is going to be accountable for the contents of your vehicle while it's in their care so they should know what's there. It's harder, but not impossible, to impound and search a car if you stop on private property. I would never counsel a client to consent to a search in the interests of expediency - it basically gives the cop a hall pass and cures any Fourth Amendment violations.

 

I have two conditions when I watch traffic while heading home:

1) Driving an exotic (now just a RR so not much of a concern these days)
2) Leaving the casino or private poker game

If I think I’m being followed I make 4 right hard turns, if they follow me I have a problem.

Why? From stories just like this, and fellow poker players being followed and robbed.

Color me paranoid.
