Where's my Ferrari 360 I bought? My CNC Motors story

    On January 13, 2021 I purchased a 2000 Ferrari 360 red/tan for $75,000 at CNC Motors (Lotus of Upland LLC). I live in Northern California and flew there, signed all the DMV paperwork, handed over my cashiers check and started driving home.



    On the way home it was not shifting properly, but was always able to find the right gear it needed to be in. The next day I noticed oil on the ground in my garage. I texted a picture of the oil to my sales person and had already let him know of the shifting issue. I had found a local Ferrari tech in my area and took it there. CNC and the Northern CA Ferrari tech spoke on the phone in length and they wanted him to diagnose it and let them know the problems. It took the tech a long time to diagnose it and CNC changed their minds about working with him and wanted to send a truck to pick it up in pieces and take it back to CNC so they could work on it. We worked out a 3 way agreement and the car was shipped back to CNC on February 21, 2021.



    After trying to find out for 3 weeks from CNC what was going on with it and the status, I finally hear back that they didn’t have enough service employees but wanted to get to it that week. As upset as I am, there’s nothing I could really do about it since its in pieces 500 miles away from me.



    In the mean time, I’m making payments on a car I don’t even have in my garage. Finally there is some progress and they have replaced the heat exchanger and flushed the gearbox. Alas that did not fix the problem and I am no longer getting communication from CNC.



    Then I see Shane’s YouTube video about his yellow F430 and how he was trying to sell it through CNC and they sold it to a buyer without his signature and they never paid him. His video exposed CNC for the title floating fraud transactions they were doing and it made me wonder… “Do I actually own this car?”



    Since I have been dealing with service problems for months, I didn’t notice I hadn’t received my registration and my bank never revived the title. I then made a YouTube video in response to Shanes original video asking for help and I want them to give me my car back or give me my money back.



    I have all my documentation from the sale, wire receipts, cashiers check photos and receipts, texts, emails, photos and more.

    Hi Matt,
    Just watched your video. I feel for you and for the others who have had similar experiences with CNC. I hope that CNC does right by you, but..... I suggest you contact others and piggyback on a lawsuit. Try not to get sucked down into an emotional rabbit hole over this. Hang in there!

    this sucks. feel bad for you guys. fwiw, id cut the video into half and you will get a lot more attention. i know your emotions are running high but it was tough to follow. agree with Mel, this is likely to be criminal and could take a long tine. try and keep it in perspective and good luck.

    Wow I have been reading about CNC since watching your video. If it were me I would show up with a flatbed truck to get the car/parts. Maybe a Repo specialist trained driver accustomed to difficult situations? I would store it (unfixed) until this is resolved.

    Please keep us posted. I am surprised you don’t have more responses here.

    Finally, if you have to find another car call Mike at Compass. I had an excellent experience getting an F430 he sourced for me off market across the country.

    UPDATE: I got my car back and it's in my garage finally!
    I went to CNC yesterday and told Clay Im taking my car. And I got it! Now for all the DMV and bank paperwork headaches. But hey, at least its finally in my possession again. It was in the service department and it was all put together. Very odd. Last time I heard it was taken apart.

    Hi Everyone,

    Long-time lurker and car enthusiast. I clearly don't post here often (sadly this is the first time), but this is a serious warning regarding CNC Motors in Upland, CA. They are currently defrauding consignment sellers (and buyers).

    I put two vehicles up for sale on consignment with CNC Motors in mid-November of 2020 - 2020 McLaren 720S Spider (VIN: SBM14FCA0LW004168) and 2017 Mercedes G550 4x4 Squared (VIN: WDCYC5FF8HX279925). CNC Motors was a reputable dealer (as far as I knew then) in the exotic car space in mid-November of 2020, with the sales guy saying he had a buyer for the 720S. Because the exotic car market has been on fire in 2020 due to lack of inventory, I didn't second guess it.

    Like many of you, I am a busy person with work, so I would occasionally reach out to my salesman (Joey Indrieri) to provide a status update, often not receiving a response via text or emails. Because of the holidays and COVID, I assumed the lack of responses were due to lack of time. After this continued into January and February, I started suspecting something wasn’t right. Finally, during the second week of February, I’d had enough of the radio silence.

    That following week I personally showed up to the dealership to find out what was going on with my vehicles. Much to my surprise, my vehicles were not at the dealership. Obviously, this was very concerning and alarming, as I was never notified that were sold. Furthermore, I received the “run around” that Joey wasn’t available to speak with me, at which point I said I refused to leave the dealership until I had answers. Miraculously, they found Joey to come talk to me.

    He acted very shady, saying my cars had sold and was “surprised that no one had reached out" to tell me this information, as he was supposedly out of the office (in the hospital) for the last 3 weeks with COVID-19. I said no one had contacted me, and he then presented the “Release of Liability” (NRL) forms for me to sign. At this point, I didn’t care when my cars had sold, I just wanted the liens paid and the remaining proceeds sent to me. At this point, my loans were not paid off on either vehicle (and STILL are not), putting me at liability risk of these vehicles for which I have liens.

    When I left that day (Wednesday, February 17th), I was promised that I would see the funds wired to my account (information which I had provided to them several times) by the end of the week. Unsurprisingly, no funds were transferred. I tried reaching out to Joey to find out the Fed wire confirmation numbers, and when the funds were sent. Two more weeks went by, and he wasn’t responding to me.

    On March 2nd, I threatened legal action if I was not paid by the end of the week. I received a response from someone named “Clay” (Clayton Thom), who I found out was the owner of the dealership. I assume that Joey was either let go / fired, and now his messages were being forwarded to Clayton now. Clayton assured me that I would be paid by the end of that week, and to send my loan payoff info, and my wire transfer information (keep in mind I’d already provided this information several times). I agreed, the week passes, and of course, no funds are in my account.

    My girlfriend and I drove out to CNC Motors again on March 12th, assuming that Clayton would have the two liens paid off, and two cashiers checks for the balance of equity I’m owed. Upon entering the dealership, the receptionist gave me the runaround, saying that Clayton wasn’t there. This obviously immediately infuriated me, and I said I wasn’t leaving. At which point, they finally called the police on me to remove me from the dealership, and the police offer said that I was one of DOZENS of times he had been called out to the dealership. At this point, I became very scared.

    The police officer said that Clayton would pay me by the end of the following week (March 19th), as he was getting a partner to buyout the business and provide him cash. I gave him the benefit of the doubt, but of course, that Friday passes with no funds in my account, and I confirmed that both liens are still not paid. Out of the blue, I get an unsolicited text from Clayton asking for my wire information (which I had provided several times). I provided the information again, hoping I would get this resolved the following Monday.

    Another week passes without payment, and I’ve decided I’ve had enough. My girlfriend suggested that I reach out to the local NBC affiliate here in SoCal to shed light on this fraudulent organization, and help get them shutdown. To this day, they are STILL OPERATING, taking from Peter to pay Paul. Many people are still getting harmed, and it needs to stop.

    I still do not know what happened to my cars, and they are both still listed for sale on their website:

    This is a fair warning to use extreme caution when dealing with CNC Motors. I have setup a blog called "CNC Motors Lawsuit" to give voice to others that have been harmed. I've filed two DMV complaints against CNC.

    Not sure if its your G 550 squared but NORMAL GUY SUPER CAR on YOUTUBE made mention by court documents to a guy in Flordia who was trying to get "his" title for a G550 that he purchased from CNC.

    It's fascinating this has been allowed to go on this long without law enforcement stepping in. If you rob a bank or person, you are immediately arrested but this has been going on for months without any arrests or prosecution. How does that happen?

    is there a reason these people that left their cars on consignment can't just report their cars stolen and create an insurance claim? I know no one wants a car back that has a branded title. I would imagine that if its on consignment, or if its sold but the deal was never completed with a payment, that it is indeed stolen isn't it?

    My dad tried that. Upload PD felt it was “embezzlement” and refused to take a report.

    I’m not surprised that clay has a “thin blue line” emblem on his Escalade. With any luck, the chickens will come home to roost. May his entire family be homeless at the end of this.

    You got the car but did u get the title? I don’t know why people can’t just post and sell there own cars? Never pay with out seeing the car. Show up get the title and keys have ur transport company standing by. Load the car and fly home. If u have to wait for transport drive car to hotel and wait. Don’t leave car with seller. To many scams

    I’ve watched a couple of the OPs videos, and there are a lot of references that he “owns” the car even though he does not possess the title.

    I would presume that the owner is really the title holder (assuming this is one of the many consignment deals going bad) who was probably not paid by CNC since making money on both ends of a consignment deal was a key part of the scheme. If this is the case, would the title holder (owner) want the car back instead of going through the court process to collect money from whatever is left of CNC?

    It just seems like at the end of the process including probable bankruptcy, a guy like the OP might end up without a chair when the music stops. Stinks for all the parties involved.

    Another question is does the OP want to keep a 360 F1 that needs $30k of repairs?

    TOO GOOD TO BE TRUE
    I shoulda picked it up earlier--something isn't right. I'm talking about a fancy dancy exotic car dealership in the Inland Empire part of SoCal.
    They had a fabulous showroom overlooking the 210 freeway and were full of exotic cars--Ferraris, McLarens, Lamborghinis.
    Local collectors thought this was the cat's pajamas--a place they could take their exotic to, leave it on consignment and drive out in another before the one they left was sold.
    But I think I began to wonder when they hosted a drive up nearby Mt. Baldy for exotic owners but when we arrived at the parking lot, no coffee and donuts. What was the point of inviting us car owners with no vittles? Even when Ford hosted Cars 'n Coffee in Irvine the food was free.
    I first saw the story break on Ferrarichat.com, an excellent website where it has many forum sections on regional localities where , say, So Cal residents can pass on local news. A few months ago postings began appearing from exotic car owners that they went to the dealership in question and their car, left on consignment, was missing. Come to find out it was on another dealer's lot far away. Or they were paid a check that bounced. Or the salesman that handled it was no longer in their employ.
    Now the dealership is empty. You could fire a cannon through it and not hit anybody. The dealership has re-opened under another name in another less flashy location but their credibility is gone.
    Lesson to be learned? Don't leave your car on consignment and drive out with another because in effect you made a trade. Once you do that you are giving them blanket permission to do what they want with your collateral.
    Another suspicious warning light was I didn't see much servicing equipment. I heard they would send cars left on consignment to outside shops for servicing,. Which means they only want to be about selling.
    I know the authorized dealers charge up the yin yang (Is that a Chinese word?) but they usually only become authorized after Ferrari checks them out.( I noticed years previously they never gave Symbolic another flashy dealer, in LaJolla, the green light
    and those founders later went to jail). So the lesson here is when your internal warning light flashes, pay attention.
    And if the deal they offer you sounds too good to be true, turn your feet to the exit and march forthwith out the door...your keys in hand.
    I'm just sayin'.....
