    Well, you would begin by buying a 250 GTE that had body damage because the body panels are all that's here. There's really nothing here to be rescued.

    Back in 2011 Michael Sheehan had offered a different car, 0373 GT. He noted that in 1995, while that other car was owned by Joe W. Moch, it was being worked on by Terry Myr and Kleeves Company. Their records show that for their project, the Ferrari 250 GTE S/N 3593 was purchased and its engine and differential were installed into 0373 GT.

    Then, in 2002 the frame of 3593 was auctioning off via eBay. If I recall correctly, L. Wayne Ausbrooks reported it having been used for a 250 SWB Berlinetta recreation.

    In 2009 a VSCDA race car incorporating small portions of the (supposedly) 3593 body, mainly partial front and rear clips, were being auctioned on eBay.

    In January 2018 it sounds as you are reporting that an engine stamped 3593 has surfaced in the hands of the 1995 owner.

    In the spirit of learning from our combined knowledge, maybe you can now step in and contribute whatever factual/verifiable information that you have with respect to that engine that has surfaced - starting with a photo of the numero interno?

    Assembled Vehicles
    Some owners want to know how they can title and register an assembled vehicle. An assembled vehicle is:

    1. One built (assembled) from new or used materials and parts by someone not recognized as a manufacturer (usually an individual). Example: homemade vehicle.
    2. One altered or modified to the extent that it no longer reflects its original manufacturer configuration. Example: a Volkswagen made into a dune buggy.
    3. One which has had its body replaced with that from another vehicle. Example: pickup truck has its cab replaced.
    4. One assembled from a kit (often called "kit cars"), even if a Manufacturers Certificate of Origin is provided.

    Procedure to title an assembled vehicle:
    1. You will need ownership documents for all vehicles or major component parts used in assembling the vehicle. This includes:

    Titles
    Assigned ownership documents (example: Release of Abandoned Vehicle notice from police department)
    Original bills of sale

    The following parts must be accounted for in the ownership documents presented:

    Motor Vehicle Engine, Transmission, Body Parts (doors, front and rear clips), Frame including axles.
    Motorcycle Engine, Frame, Front end assembly including the fork, Wheels, Seat
    Titled Trailer or Trailer Coach Running Gear (frame axle and wheels)
    2. You will also be asked to complete a certification statement summarizing the building of the vehicle. It should include:

    A description of the vehicle and its parts,
    Who assembled the vehicle,
    When and where it was assembled or reconstructed,
    Any special information about the vehicle to assist the investigator.

    3. A Vehicle Number/On-Road Equipment Inspection (form TR-54) completed by a MI police officer must be submitted. The inspection will verify the vehicle has all equipment required for on-road registration.

    4. All assembled vehicles require a state-assigned vehicle identification number (VIN). There is a $10 fee for this.

    5. When you apply for your assembled vehicle title, tax is due on all parts unless paid at time of purchase.

    6. A license plate or 30-day or 60-day temporary permit cannot be sold until the Department's Regulatory Monitoring Division places the assigned VIN sticker on the vehicle and releases the new title to the owner. The Regulatory Monitoring Division will contact you for an appointment, usually at a local State Police Post or Secretary of State branch office.

    Andrew, the owners of 0373GT are known, and the person behind the 3593 bodied road race car (and its, ehem, final "disposition") are also known. However, for those in the known, your introduction doesn't make clear what your personal interest is in those cars - so you offer nothing to motivate any action.

    You did mention possibly knowing of an engine stamped 3593. But you didn't state your role with respect to that engine: are you the owner/seller, have you been formally tasked by the owner - and if so in what role, etc. Without stating your interest and role, people have little reason to be in communication with someone who might not even be authorized to speak on behalf of the engine's owner.

    Next, your messages cite various legislation, but why would the owner of 0373GT, or the 3593 chassis, or the 3593 body parts and pieces, care that you have come across some 250 GTE engine (or that you have discovered how to copy and paste links and content from various web sites?)

    For all I know, you may have a very legitimate concern - and the best way to engage the membership of this forum is by being forthcoming with your own role and facts, and THEN you'll find that people will be happy to fill in the gaps.

    On April 29, 2015, following a jury trial that began on April 22, 2015, Defendant Terry Myr ("Defendant") was found guilty of tax evasion pursuant to 26 U.S.C. § 7201 (Count 1). In addition, Defendant was convicted of willful failure to file pursuant to 26 U.S.C. § 7203 for each year 2007 through 2010. (Counts 2 through 5 respectively).

    Currently before the Court is Defendant's motion seeking a new trial under Federal Rule of Criminal Procedure 33.1 Specifically, Defendant argues that the Court should have admitted at trial a civil complaint filed by the Department of Justice seeking a permanent injunction against the business and individual who prepared a tax return that was evidence in the trial.

    For the reasons stated more fully below and on the April 27, 2015 trial record, the Court denies Defendant's motion.

    I. Background

    Defendant is a self-employed automotive mechanic who specializes in exotic foreign cars. From approximately 1998 though 2001, Defendant filed individual tax returns. The IRS audited his 2000 and 2001 returns. Defendant directed a certified public accountant to prepare his 2002 and 2003 individual income tax returns, but did not file these returns. In November 2005, the IRS assessed Defendant approximately $195,163 in taxes, interest and penalties for years 2000 through 2003. Defendant neither paid nor filed another federal income tax return. In May 2007 the IRS issued a Notice of Federal Tax Lien against Defendant's property.

    During 2009, Defendant negotiated to sell a rare 1954 Ferrari race car engine for $610,000. Defendant established a corporation called On Track Group, Inc. The engine purchaser wired the funds to On Track Group, Inc.'s bank account. The following year, Defendant filed a 2009 tax return for On Track Group, Inc., which reported only $500,000 in gross receipts, falsely claimed expenses in the amount of $150,000 for employee salaries, falsely claimed a "bad debt" in the amount of $330,174, and reported a loss in the amount of $10,520. The tax preparer was Dr. Denise Miller with Uneek Business Solutions. Although it was not a basis for a charge, this tax return was evidence at trial. Defendant testified that he signed and filed the return without reading it.

    OPINION AND ORDER DENYING DEFENDANT'S MOTION FOR NEW TRIAL [35]

    For the reasons stated more fully below and on the April 27, 2015 trial record, the Court denies Defendant's motion.

    I. Background

    Defendant is a self-employed automotive mechanic who specializes in exotic foreign cars. From approximately 1998 though 2001, Defendant filed individual tax returns. The IRS audited his 2000 and 2001 returns. Defendant directed a certified public accountant to prepare his 2002 and 2003 individual income tax returns, but did not file these returns. In November 2005, the IRS assessed Defendant approximately $195,163 in taxes, interest and penalties for years 2000 through 2003. Defendant neither paid nor filed another federal income tax return. In May 2007 the IRS issued a Notice of Federal Tax Lien against Defendant's property.


    During 2009, Defendant negotiated to sell a rare 1954 Ferrari race car engine for $610,000. Defendant established a corporation called On Track Group, Inc. The engine purchaser wired the funds to On Track Group, Inc.'s bank account.

    For what it's worth, I obviously know which two cars Joe Moch had considered to supply the engine for 0373, and which cars Terry Myr had inspected for him, before Moch settled on #3593. I also know from whom Moch then purchased that car. I do know about the rebuilt performed by Myr with respect to the 6-carb setup and SEFAC-type heads of the engine, etc. And of course, I know who ended up purchasing the remaining parts of #3593 - so the "passage" of that car from owners prior to Moch and subsequent to Moch are no secret. Furthermore, there are also pictures of the engine used in 0373, showing its № Int. - as well as what the stamping looks like now. So if ever there is a party that can demonstrate legitimate interest there is a good chance that by collaborating, progress could be made in reconciling any possible discrepancies.     "The short wheelbase Breadvan is one of those Le Mans stories born out of the events generated by Enzo Ferrari's effervescent character. And while the French media called it La Camionnette (the little truck), neither this nor the Breadvan designation given by the international media told the real story of the car, which was more of an apple of discord. At the time when the Breadvan showed up (1962), Ferrari has just moved on from the 250 GT SWB to the 250 GTO SWB racecar. However, Enzo refused to sell any GTOs to Count Giovanni Volpi, so the man commissioned the Breadvan, which was based on a 250 GT SWB. The refusal came after the Count had hired ousted Ferrari employees, with the story turning into a quest to smash Enzo on the track using a new team (and car company). With great engineering and design effort having been put into the creation of the Breadvan, the result turned out to be faster than Ferrari's 250 GTO, even though reliability issues kept it from achieving full glory".

I was next to the owner's long time Louisiana friend and he and those in his group were quite shocked that the 1512 sold and that the owner's other car did not generate the interest Christie's had promissed. There was NO bidding at all on the Breadvan.

    What is the Breadvan?? An SWB with a wrong engine and a rebody. Is it worth US$ 3.5 M or more?? Most probably not. The original SWB Berlinetta Scaglietti body of the Breadvan today is on the off-white 250 GT SWB Berlinetta #2439 GT which Bonhams had in Monterey for sale by private treaty (it is still owned by a Swiss collector). Now, one should buy both the off-white SWB 2439 GT AND the Breadvan 2819 GT, then remove the SWB body and put it on the Breadvan chassis 2819 GT and locate the original Breadvan engine 2819 GT, in order to make it a genuine SWB Sefac Hot Rod...........
