Anything new on this case? I haven't heard anything since the arrest back in Sept of last year. Thanks
The driver's DNA has been in the airbag, all this time. You do need a swab, to match it to. It sounds like the cell phone records, would have told the tale also..... People forget, they leave footprints......
Though the wheels of justice may turn slowly, they grind exceedingly fine. About time. Can't imagine the source(s) of the delay... CW
Does anyone have any info on this? Last I can see is "Radomin Vicente Delgado Lozada" was arrested in 2014 Sept, but nothing after that. Did he go to court? There was a civil case against him earlier that was settled regarding the accident. I mean did this guy walk? Did money give him a free pass?
I've been wondering about this too. Somebody down in SoFla must have some recent information. I have a sickening feeling a cash settlement to the victims' families and maybe some kind of self-deportation deal for the perp made criminal charges disappear. I sent an email to the reporter who wrote the story in Sept., 2014. If I get a response I'll post it here.
He was charged for leaving the scene of a fatal hit and run but never for manslaughter or anything of that sort. One earlier post here did say that the deceased driver could have crossed the path of the Scuderia which would result in shared responsibility. Anyone here has any real information that says the Scuderia driver was clearly at fault?
It's not hard to get status, just read the docket. Go here: https://www2.miami-dadeclerk.com/cjis/casesearch.aspx State Case No.: 13-2014-CF-019618-0001-XX (you must look under state case #, not just case #) Subpoenas for trial went out on 4/4/2016. There is a status conference set for 4/25/2016 (TODAY) at 9am. Trial has been scheduled for 5/2/2016. They are still taking depositions and if they don't file a Motion for Continuance, the trial will be going forward on that date. Basic info: Name: DELGADO LOZADA, RADOMIN VICENTE Date of Birth: 08/03/1971 Date Filed: 08/29/2014 Felony charge: leaving the scene of an accident with a death PLEA: NOT GUILTY His bond was $15,000 He is not currently in jail I also found that he got a speeding ticket in Broward County for going 105mph in a 70 on 10/12/2012... "Just two or three minutes later, there was a noise like an explosion as Delgado's cherry red Ferrari F430 Scuderia rear-ended the Hyundai, which hit a third car, a Saturn, before tumbling end over end and slamming into the median (Roustan & Sweeney)." Without looking at all three vehicles to see where the points of impact were, it appears he is 100% at fault. He rear-ended the Hyundai AND pushed it into another car. Source: Ferrari driver arrested in fatal hit and run, FHP said - Sun Sentinel There was also a civil case against him that was filed by the decedent's partner on 5/7/2014. It appears to have been settled on 7/7/2014 between the two parties because they agreed to dismiss with prejudice. The amount demanded was in excess of $15,000. You're welcome. I trust that going forward, no one will just say, "What's the status?" We can all look it up. Status hearing has been reset for 5/31/2016 Trial hearing set for 8/29/2016 Motion for Continuance was filed, as I figured it would be. Their discovery is still ongoing and they just sent subpoenas for deposition in March. Hopefully they will wrap it up before the next status hearing, but we'll see... The docket was updated this morning with the aforementioned: Image Unavailable, Please Login
Thanks for posting! I was just searching news archives thinking things should have been settled by now.
Well, if the bond is $15,000, that means bail was $150,000 and they have had to provide collateral of $135,000 (deed to a house, check for that amount, etc.). It's nothing to sneeze at, but it's hard to put a price tag on a human life. I'm sure that between the bail, bond, civil suit settlement, and the attorney fees, this has put a serious financial strain on the defendant.
To bring things current, are there even a list of charges posted? Leaving the scene of an accident, even a minor fender bender, is usually taken very seriously by law enforcement. So, that in itself is a pretty major charge. Add in likely DWI, driving at well above the posted speed limits, vehicular homicide, etc. a guy with a Ford Taurus in the same circumstances would have had the book thrown at him instantly and he would have been locked up immediately.
