    It's time for another installment of Carsumer Advocacy. We won't go into the nitty gritty details of this one, as it's spread across a 61-page forum post on VW Vortex. The basic gist is that a guy moved into a house in a nice neighborhood. Said neighborhood then started a Home Owners Association with an annual fee of over $1,500. The new HOA then hired an outside contractor to police parking inside the neighborhood. Parking passes were then required that had to be displayed within the vehicle at all times, even when parking in your own driveway (!). If the loose passes (they weren't stickers) weren't displayed, a homeowner would get a $140 ticket and a couple of boots slapped on his or her wheels until the ticket was paid.

    One day, forum member The A1 and A2 German forgot to hang his parking pass on the rearview mirror of his mildly tuned Audi A4. The boots came, but rather than acquiesce, he got some rolling jacks and wheeled his car, boots and all, back into his garage. It's the principal of the thing, as this guy apparently always used his parking pass and, despite the rent-a-cops knowing his vehicle, they ticketed him and gave his car the boot anyway. Then the standoff began. This guy was smart and called the police to make sure he wasn't doing anything illegal like stealing the contractor's boots, and when the HOA contractor's eventually found out where their they were hiding, he was happy to let them come and retrieve their property. The contractor now his boots back, but the man's parking pass has been revoked and apparently his neighbors are now being terrorized by these boot police who are hell bent on revenge.     It's not really "parking on your own property". He lives in a condo community with parking spaces for residents and guests. He was parked in a resident space, apparently one he frequents, without the tag displayed when booted.

    As for who granted Arizona Parking Solutions the right to do this - no one really. They are in violation of the terms of their contract by booting on first offense, but that didn't seem to matter to them. The HOA hired them and pays them $1000 per month for such service.

    Bizarre. Difficult to believe any HOA would allow the antics of APS to persist. Perhaps members of the board have a reciprocating financial arrangement.....

    Actually it seems they were a bit unaware of the situation of how enforcement was being implemented. Given their support so far for the resident I suspect they will be giving their 30-day notice to cancel the contract soon, if not already.

    No problem. Go to a parking enforcement supply company and buy your OWN boot. Park anywhere you want at any time. Pull the boot out of the trunk and lock it on your own car. Anybody who drives by will laugh and point at the poor sucker's car who got booted. Little do they know. When it's time to leave, unlock your boot, toss it in the trunk and drive away happy!

    Thanks for reminding me why I live on acreage in an agricultural zoned area...I suspect this type of revenue gathering conduct will increase as people are having trouble paying their mortgages and skipping the HOA fees causing the HOA are struggling to survive...

    WOW... doesn't suprise me that that is in AZ.

    Many of the communities are littered with these parking Nazis. It is ridiculous. You pay them... and then when you leave your car outside for a minute and they slap a ticket on it. BULL**** I say.

    I have a funny story about that actually.

    I had a 97 viper GTS that I drove on the street with only one muffler and no cats, rockers, smooth tubes blah blah blah blah never the less it was loud (it also always wore R compound rubber) The builder of my community built my garage much higher than the rest of my community... so i have to go into my garage at a massive angle to get my car in side. Once inside i have to do a million point turn to get the car on its side of the garage. Then i have to park my truck next to it. so when I wanted to drive the viper... it was a cluster ****. Move the truck. Million point turn the viper to get it in the center of the garage, in order to cut the wheel and creat and angle that would only slightly rub the bottom of the car (not just the nose, the middle of the damn car) The builder said they would fix the drive way... and then they never ever did. we set appointments etc and they always no showed. Anyways, the people who lived in my my same building (3 units per building) was one of the self proclaimed parking nazi. One day, I came home and had to run inside and change and be on my way... so i was like skrew it.. .ill park in guest parking and be on my way in a few no big deal. I park in guest parking and like 3 days later i get a letter with a fine and a picture of my car in guest parking and from the angle, it was taken by a prick in my building (self proclaimed parking nazi) So, after that I made it my point to come home as late as possible, always allow my car to warm up to full opperating temp in the garage as well give the car 1500 rpms when manuvering in and out of the garage just to piss this ******* off. Before this, if it was late at night I would do everything in my power to be as quiet as possible and if it was late I just wouldn't drive the car or I would drop the car at my parents house and take my elise home from there house. So one night, I get out of my car and the guy is standing right behind me as I exit the car. The guy is just BENT. (its like 7:30) he is like do YOU F'n mind you inconsiderate prick. I have a F'n kid who is trying to sleep. WHy the F do you drive such a loud car etc... I said because its in my right and I want to. I then introduced myself and apollogized for the noise and explained to him that my excessive parking manuvers were do to the fact that my drive way was built to steep and I pointed out the chunks of my driveway missing from my car(S) scrapping. I pointed out to him that if i could just leave my car in the middle of the garage and leave my truck outside it would be much quieter for him but since he insisted on ticketing me he was now going to have to learn to live with my obsurd parking situation. He then appologized and since then, i have never had to park my truck inside... no more absurd parking situation, other than the fact that I have a two car garage that only one car fits in and I have to leave my truck outside in the sweltering sun... BUT... the neighbors are happy and at least the important cars get to sleep inside. never had a problem since... just so you guys know, I am like the quietest person in the community... i never have people over other than my girlfriend and house keeper, I don't drink smoke party etc... In fact the only neighbors that I have met are this one guy who was pissed, and like 3 others in 3 years who have just come by to say that i always have "cool cars." One lady says that she keeps an eye on my house to make sure no one trys to steal my car and occasional car(S) that are inside. so I must be doing something right with them.

    Back on the subject of boots and towing

    Many of these communites were built by a bunch of dumbass "realestate investors" who have NO business in realestate. These people only cared about the dolor and maximizing the houses on the community vs. making the community a nice community they could be proud of and using it as a reference for there future products. If you live in AZ you know who these ****** bags were or at least looked like. (very easy to pick them out, look up jeremey clarksons impersonation of an M3 driver.) anyways, 99% of these communites do NOT have enough parking! then they are enforced by these douchbag HOAs who ticket the **** out of the homeowners for doing stuff thats 100% by the books. In 99% of comunitess if you read your HOA agreement, you will find that everyone has 6 hours to load and unload there vehicle in guest parking before being towed or booted. By law, they have to have a police officer verify that the car has been there for 6hours... Now most of these HOAs are in cahoots with the tow companies and the tow companies are so horny to tow something that sometimes they tow the wrong cars or these cars that are legitimately parked in guest parking. One of my buddies actually went down to the tow yard and said that he wanted to see evidence that his car was parked in guest parking for more than 6 hours... they knew they were guilty of not abbiding by the rules and gave him his car back with no fine/penalty. Now whenever i see a tow truck in the community I always walk up to the driver and say... hey, you better get a cop out here to verify this or I will call them and say that you are illegally towing cars. i haven't seen a tow truck in my commuinty for 6 months...

    In theory HOA's are a good thing. But it get's to a point where they either **** things up and invoke pointless, PC, rules, or hire dip****s like this.
